Who collects and processes your Personal Data?

This privacy policy (the “Privacy Policy”) describes the collection and processing of information about you that can directly or indirectly identify you (the “Personal Data”) carried out by virtual reality applications such as Shave & Stuff, Pets & Stuff, Zombie Cleanup Service, Titans Clinic, Hide the Corpse (each the “App” or together “Apps”), which are also available on platforms (Meta Quest, Steam, PlayStation, Pico etc.) (the “Platform”). This Privacy Policy applies to all our Apps, the list of which may change from time to time, unless otherwise specified in a particular App.

When you play the Apps developed by us and/or by our partner developers we can collect your Personal Data.

This Privacy Policy provides (1) the Apps users; and (2) other subjects with information on which Personal Data we collect and how we process such Personal Data. Unless expressly provided otherwise, all of the following terms apply to all of the above categories of data subjects.

The controller of your Personal Data who determines purposes and means of the processing is Hyper Reality SIA (“we”, “us”, “our”), registered in the Register of Legal Entities of the Republic of Latvia under Registration Number 40203309134, legal address: Dzirnavu street 41-11, Riga, LV-1010, Latvia.

How do we collect your Personal Data?

We collect Personal Data in the following ways:

  1. if you provide it to us (for example in case when you contact us); or
  2. automatically by electronic means (for example, when we connect third-party analytics services for the purposes set forth in the Privacy Policy below); or
  3. if we receive your Personal Data from third-parties (for example, when you download our Apps, we may receive some Personal Data from the platforms through which you download the relevant App).

How do we handle children’s Personal Data?

Shave & Stuff, Pets & Stuff, Titans Clinic, Hide the Corpse

General provisions.

The Shave & Stuff, Pets & Stuff, Titans Clinic and Hide the Corpse Apps (the “Apps for children”) are designed for use by children, that is, persons under the age of 13 (in the US) and 16 (in the EU). The Apps for children are included in the age category “USK 0”. We are committed to protecting the privacy of children who use these apps.

The Apps for children are intended for parents to use with their children. Children under 13 (in the US) and children under 16 (in the EU) may only use the Apps for children if we have obtained verifiable advance parent or guardian consent.

We comply with COPPA, CCPA and GDPR, which among other things requires that we obtain verifiable parental consent before we collect children’s Personal Data who are under 13 (in the US) and 16 (in the EU). Therefore, we only collect Personal Data through the Apps for children from a child under 13 (in the US) and 16 (in the EU) where that child’s parent or authorized legal guardian has expressly agreed.

If you are a person under 13 (in the US) and under 16 (in the EU), please do not send any Personal Data to us if your parent or guardian has not expressly consented. If you are a parent or legal guardian and believe that your child has provided his/ or her Personal Data without your consent, please contact us at data@hypervr.games. If we learn that a person under 13 (in the US) and under 16 (in the EU) has provided us with Personal Data beyond what we request, we will delete that information as quickly as possible.

Transferring of children’s Personal Data

We do not transfer the children’s Personal Data to any third party unless it’s required for the business to operate Apps for children. Nevertheless, we may share or disclose children’s Personal Data if permitted or required by law.

To the extent permitted by applicable law, we also may disclose children’s Personal Data:

Zombie Cleanup Service

Our App “Zombie Cleanup Service” is rated 16+ on the Meta Quest platform. In accordance with platform policies, this App cannot be installed or used by individuals under the age of 16. We do not knowingly collect or solicit Personal Data or target ads to anyone under the age of 13 (in the US) and 16 (in the EU). If we learn that we have collected Personal Data about a child under these ages through the Zombie Cleanup Service App, we will delete it as quickly as possible. If you believe that we might have any Personal Data from or about a child under these ages, please contact us at data@hypervr.games.

How can we update this Privacy Policy?

We may periodically update this Privacy Policy. If we make changes to the Privacy Policy, we will update the update date at the top of the Privacy Policy. Your continued use of the Apps after the effective date of the updated Privacy Policy will be subject to the new Privacy Policy. If we make any major changes and need your explicit consent for further processing, we will request your consent or renewed consent.

Which Personal Data do we process and how?

We respect your privacy and aim to limit the Personal Data that we collect from you to the amount which is strictly necessary.

What is the data retention period?

We exclusively collect your Personal Data without retaining it. All Personal Data is stored on your devices as long as you’re using our Apps.

Third-party collaborators follow their own retention policies (see below).

We do not use automated decision-making or profiling.
